Revenge Porn Is Illegal — And You Have Rights
Non-Consensual Sharing Is a Crime — And You’re Protected
Having your private photos or intimate videos shared without your consent is more than an invasion of privacy, it’s a crime. Whether the content was posted online, sent through text, shared in a group chat, or circulated without your permission, the law protects you.
You don’t have to face this alone.
What Is Revenge Porn?
Revenge porn (also known as non-consensual intimate image sharing) occurs when someone distributes private, intimate, or explicit images without the consent of the person shown. This can include:
Photos shared during a relationship
Screenshots of intimate messages or videos
Leaked cloud backups
Edits or reposts
Content shared through threats, coercion, or harassment
Once shared, intimate content can spread quickly, but the law provides tools to stop the harm and hold the responsible party accountable.
What Laws Protect Victims?
Both federal and state laws prohibit the sharing of private intimate images without consent.
Under 15 U.S.C. § 6851, victims may be entitled to:
- Court orders requiring removal of the content
- Orders preventing further sharing
- A statutory damages award of $150,000 (plus attorney’s fees and costs)
Because attorney’s fees and legal costs are recoverable, victims are entitled to at least $150,000, and in some cases more, depending on the circumstances and additional claims.
Many states also provide criminal penalties, meaning offenders may face both financial consequences and criminal charges.
What Evidence Can Help Strengthen a Case?
You do not need to investigate the situation yourself or confront the person responsible. However, the following may be helpful:
- Screenshots or saved links of the shared content
- Timestamps, platform notifications, or metadata
- Text messages, emails, or social media messages showing threats or distribution
- Witness statements or digital traces
- Any proof showing you did not consent
Even if the content has been deleted, you may still have a case. Platforms store records, and legal tools such as preservation letters and subpoenas can secure evidence.
